- Fraudulent activity attributable to you;
- Inaccurate information supplied by you;
- Violation of Applicable Laws.
- LIMITATION OF LIABILITY
To the maximum extent permitted by Applicable Laws, Britam shall not be liable for: • Indirect losses;

- FORCE MAJEURE
Neither party shall be liable for delay or failure in performance arising from events beyond its reasonable control including:

- Labour disputes;
- Cyber incidents;
- Utility failures;
- Acts of government;
- Civil unrest;
- War;
- Terrorism;
- Infrastructure failures.
Where a Force Majeure Event continues for more than ninety (90) consecutive days, Britam may suspend or terminate affected services.
- TERMINATION AND SUSPENSION
Britam may suspend, restrict, or terminate access where:

- Fraud or suspicious activity is detected;
- Security risks are identified;
- Identity verification fails;
- These Terms are breached.
Termination shall not affect rights or obligations accrued prior to termination.
- MISCELLANEOUS
Severability
If any provision is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Waiver
Failure by either party to enforce any provision shall not constitute a waiver of that provision. Assignment
You may not assign your rights or obligations without Britam's written consent. Britam may assign its rights and obligations within the Britam Group or otherwise as permitted by law.
Notices
Notices may be delivered electronically, by hand, courier, post, SMS, or through the Website. Entire Agreement
These Terms, together with applicable Product Terms and the Privacy Statement, constitute the entire agreement between you and Britam regarding the Website.
- GOVERNING LAW AND DISPUTE RESOLUTION
These Terms and Conditions shall be governed by the laws of the jurisdiction in which the applicable Britam entity providing the Product or Service is incorporated, unless otherwise required by Applicable Laws.
Customers should first submit complaints through Britam's established customer complaints channels.
Where permitted by law and where disputes remain unresolved, either party may refer the dispute to arbitration or another recognized dispute resolution mechanism in accordance with the applicable laws and regulations of the relevant jurisdiction.
Nothing in these Terms shall limit a customer's right to seek assistance from any competent regulator, supervisory authority, consumer protection authority, data protection authority, insurance regulator, financial services regulator, or court of competent jurisdiction where permitted under Applicable Laws.
