Terms And Conditions

 

  1. INTRODUCTION 

These Terms and Conditions govern your access to and use of the Britam Website and any Products or  Services offered through it. 

This Agreement applies if you have a policy, account, product, or service relationship with any member of  the Britam Group or if you register to access and use the Website. 

By registering for, accessing, browsing, or using the Website, you acknowledge that you have read,  understood, and agreed to be bound by these Terms and Conditions, together with any applicable  Product Terms, Privacy Statement, and any other policies referenced herein. 

Britam may amend these Terms and Conditions from time to time. Any amendments shall become  effective upon publication on the Website or such other date as may be specified in the amendment.  Continued use of the Website following publication of such amendments constitutes acceptance of the  revised Terms and Conditions. 

  1. DEFINITIONS AND INTERPRETATION 

In these Terms and Conditions: 

Applicable Laws means all laws, regulations, directives, regulatory guidelines, industry standards,  sanctions requirements, and legal obligations applicable to Britam, its subsidiaries, customers, products,  services, and operations in the jurisdictions in which Britam operates. 

Britam, We, Us, or Our means Britam Holdings PLC and its subsidiaries, affiliates, and related entities. 

Credentials means any username, password, authentication code, one-time password (OTP), security  token, biometric authentication, or any other security information used to access the Website. 

Customer, You, or Your means any person, business, or entity accessing or using the Website. 

Personal Data means information relating to an identified or identifiable natural person as defined  under applicable data protection laws. 

Website or Site means the Britam Buy Online Website, including any associated websites, mobile  applications, or digital platforms operated by Britam. 

Products means insurance, investment, financial, health, property, pension, or any other products or  services offered through the Website. 

Privacy Statement means the Britam Group Privacy Statement as published and updated from time to  time. 

Electronic Instruction means any application, request, transaction, authorization, approval,  communication, or instruction submitted through the Website.

  1. REGISTRATION AND ACCESS 

Britam reserves the right, at its sole discretion, to approve, reject, suspend, or terminate any application  to access the Website. 

Access to the Website may be subject to identity verification, Know Your Customer (KYC) requirements,  anti-money laundering checks, sanctions screening, fraud prevention measures, and other regulatory  requirements. 

Britam may require additional information or documentation before granting or continuing access to the  Website. 

You agree that all information provided during registration or while using the Website shall be true,  complete, accurate, and up to date. 

  1. ELECTRONIC TRANSACTIONS 

You acknowledge and agree that: 

  • Electronic Instructions submitted through the Website shall be legally binding. 
  • Records generated by the Website may be relied upon as evidence of transactions and  communications. 
  • Electronic acceptance, acknowledgements, approvals, declarations, and confirmations shall have  the same force and effect as handwritten signatures where permitted by Applicable Laws. 
  • Britam may act upon any Electronic Instruction reasonably believed to have originated from you.
6. SECURITY OF ACCESS

Britam shall provide or facilitate the creation of Credentials for access to the Website. You shall: 
  • Keep your Credentials secure and confidential. 
  • Not disclose Credentials to any third party. 
  • Immediately notify Britam of any unauthorized access or suspected compromise. • Maintain adequate security on devices used to access the Website. 
  • Install security updates and anti-malware protection where appropriate. 

Britam may implement: 

  • Multi-Factor Authentication (MFA);
  • Biometric verification; 
  • Fraud detection controls; 
  • Device authentication; 
  • Transaction monitoring and verification procedures. 

Britam shall not be liable for losses resulting from unauthorized use arising from your failure to protect  your Credentials. 

  1. USE OF THE WEBSITE  

You agree that you shall not: 

  • Use the Website for unlawful purposes; 
  • Upload malicious code, viruses, malware, or harmful software; 
  • Attempt to gain unauthorized access to systems or data; 
  • Circumvent security controls; 
  • Interfere with the operation of the Website; 
  • Misrepresent your identity; 
  • Use the Website in a manner that could damage Britam's systems, reputation, or business. 

Britam reserves the right to suspend, restrict, or terminate access to the Website where these Terms are  breached or where fraudulent, suspicious, or unlawful activity is detected.

Britam will use reasonable efforts to maintain the availability of the Website but does not guarantee  uninterrupted or error-free access.

  • Circumstances beyond Britam's reasonable control.

Britam does not endorse and shall not be responsible for:

Your use of third-party services is subject to the applicable third-party terms and conditions.

12. NO OFFER OR FINANCIAL ADVICE 

Information contained within the Website is provided for general informational purposes only. Nothing contained on the Website constitutes:

  • Legal advice; 
  • Tax advice; 
  • An offer capable of immediate acceptance unless expressly stated.

Britam processes Personal Data in accordance with Applicable Laws and the Britam Group Privacy  Statement.

  • Product administration; 
  • Claims processing; 
  • Customer support; 
  • Fraud prevention and detection; 
  • Regulatory compliance; 
  • Risk management; 
  • Business operations; 
  • Service improvement and analytics. 

Britam shall implement appropriate technical and organizational safeguards to protect Personal Data  against unauthorized access, disclosure, alteration, loss, misuse, or destruction. 

Personal Data may be disclosed to: 

  • Britam Group entities;
  • Service providers; 
  • Reinsurers; 
  • Regulators; 
  • Auditors; 
  • Government authorities; 
  • Other authorized parties where required by law or necessary for service delivery. 

Where Personal Data is transferred across borders, Britam shall implement appropriate safeguards as  required by Applicable Laws. 

Subject to applicable legal restrictions, customers may exercise rights available under applicable data  protection laws, including rights relating to access, correction, objection, deletion, restriction, and  portability of personal data. 

  1. COOKIES AND ANALYTICS 

The Website may use cookies, web beacons, pixels, analytics tools, and similar technologies to: • Improve functionality; 

  • Personalize customer experience; 
  • Analyze usage patterns; 
  • Enhance security; 
  • Measure service performance.

  1. CYBERSECURITY AND FRAUD PREVENTION 

Britam may implement monitoring and security measures to prevent fraud, cybercrime, unauthorized  access, money laundering, terrorist financing, bribery, corruption, sanctions breaches, and other unlawful  activities. 

Britam shall never request your password, OTP, or security credentials through unsolicited  communications. 

You agree to immediately report suspected fraud, phishing attempts, or unauthorized account activity.

16. INDEMNITY 

You agree to indemnify and hold harmless Britam, its directors, officers, employees, agents, and affiliates  against all claims, losses, damages, liabilities, costs, and expenses arising from: 

  • Breach of these Terms; 
  • Misuse of the Website; 
  • Fraudulent activity attributable to you; 
  • Inaccurate information supplied by you;
  • Violation of Applicable Laws. 
  1. LIMITATION OF LIABILITY 

      To the maximum extent permitted by Applicable Laws, Britam shall not be liable for: • Indirect losses; 

  • Consequential losses; 
  • Loss of profits; 
  • Loss of business opportunity; 
  • Loss of goodwill; 
  • Data loss; 
  • Service interruptions; 
  • Cyberattacks originating from third parties; 
  • Failures arising from telecommunications, internet service providers, or external systems. Nothing in these Terms excludes liability for: 
  • Fraud; 
  • Gross negligence; 
  • Wilful misconduct; 
  • Any liability that cannot lawfully be excluded. 
  1. RECORD RETENTION 

Britam may retain records, communications, audit logs, transaction histories, authentication records, and  Customer Data for periods required under Applicable Laws, regulatory obligations, litigation requirements,  and internal record management policies. 

Electronic records maintained by Britam shall constitute evidence of activities conducted through the  Website. 

  1. FORCE MAJEURE 

Neither party shall be liable for delay or failure in performance arising from events beyond its reasonable  control including: 

  • Natural disasters; 
  • Epidemics or pandemics; 
  • Labour disputes; 
  • Cyber incidents; 
  • Utility failures; 
  • Acts of government;
  • Civil unrest; 
  • War; 
  • Terrorism; 
  • Infrastructure failures. 

Where a Force Majeure Event continues for more than ninety (90) consecutive days, Britam may suspend  or terminate affected services. 

  1. TERMINATION AND SUSPENSION 

Britam may suspend, restrict, or terminate access where: 

  • Required by law or regulation; 
  • Fraud or suspicious activity is detected; 
  • Security risks are identified; 
  • Identity verification fails; 
  • These Terms are breached. 

Termination shall not affect rights or obligations accrued prior to termination. 

  1. MISCELLANEOUS 

Severability 

If any provision is held invalid or unenforceable, the remaining provisions shall remain in full force and  effect. 

Waiver 

Failure by either party to enforce any provision shall not constitute a waiver of that provision. Assignment 

You may not assign your rights or obligations without Britam's written consent. Britam may assign its  rights and obligations within the Britam Group or otherwise as permitted by law. 

Notices 

Notices may be delivered electronically, by hand, courier, post, SMS, or through the Website. Entire Agreement 

These Terms, together with applicable Product Terms and the Privacy Statement, constitute the entire  agreement between you and Britam regarding the Website. 

  1. GOVERNING LAW AND DISPUTE RESOLUTION 

These Terms and Conditions shall be governed by the laws of the jurisdiction in which the applicable  Britam entity providing the Product or Service is incorporated, unless otherwise required by Applicable  Laws. 

Customers should first submit complaints through Britam's established customer complaints channels.

Where permitted by law and where disputes remain unresolved, either party may refer the dispute to  arbitration or another recognized dispute resolution mechanism in accordance with the applicable laws  and regulations of the relevant jurisdiction. 

Nothing in these Terms shall limit a customer's right to seek assistance from any competent regulator,  supervisory authority, consumer protection authority, data protection authority, insurance regulator,  financial services regulator, or court of competent jurisdiction where permitted under Applicable Laws.
